General terms and conditions

1. General information
The following general terms & conditions apply to all contracts, deliveries and other services. All ancillary agreements require written confirmation on our part. The products offered on our "St. Pauls Cooperative Winery online” website (http://www.stpauls.wine/shop) are directly marketed and sold by the
St. Pauls Cooperative Winery, I-39057 St.Pauls/Eppan (BZ), Schloss-Warth-Weg 21

St. Pauls Cooperative Winery may at any time modify or add to these general terms & conditions, including any appendices, by giving an appropriate period of notice. The latest version will be valid and applicable.

2. Prices
All of the prices appearing on our website are prices, inclusive of value added tax at the current rate of 22% applicable in Italy, plus postage costs. Our offers on this webpage are intended exclusively for final consumers and remain valid while stocks last.

3. Acceptance of orders
By sending your order you acknowledge our general terms & conditions. The sales contract comes into effect on receipt of the order.

In the case of advance payment (bank transfer), the goods will be sent following receipt of the purchase price; in the case of credit card payment they will be sent following a successful check of the credit card data and the customer's creditworthiness.

4. Delivery and payment
All offers made by the St. Pauls Cooperative Winery online are in principle non-binding. Errors on the order side cannot be excluded. We reserve the right to make changes to the offer. Our offers are without obligation on our part. Slight alterations and technical changes in relation to our illustrations or descriptions are possible.

Deliveries are only made to those countries that can be selected from the drop-down menu on the data input page.
We reserve the right to make partial deliveries if this seems an appropriate solution to ensure swift completion of the order.

Please make sure that it is possible to deliver the wine to the address you indicate. If are not at home, please indicate an alternative address like your office or any other suitable one.

The wine is sent upon receipt of the payment. If a wine is not available at the time of the purchase, we will contact you immediately.

5. Transport costs
The following delivery costs (transport and packaging) are payable by the customer:

The prices quoted do not include 22% VAT.

Order Quantities: For private use the maximum quantity you can order for each delivery is 90 liters. (Of which only 60 can be of sparkling wine)

6. Packaging:
The wine is sent in special 6, 12 or 18 bottle cardboard boxes to make sure you receive your order without any damage.

7. Transfer of risk
The risk and warranty obligations are transferred to the purchaser on dispatch of the goods by St. Pauls Cooperative Winery or on their handover to the freight company. St. Pauls Cooperative Winery expressly excludes all joint liability or risk sharing or warranty for any action or damage that is due to the activity of the liable freight companies or that falls within their area of law.

8. Complaints
Should a wine supplied by us prove defective, the bottle, cork and contents must be retained and St. Pauls Cooperative Winery informed. The product subject to complaint must be returned to St. Pauls Cooperative Winery on request. We will examine the item and refund the purchase price to you if the complaint is justified.

9. Right of withdrawal
Cancellation must be made by post, by fax, by email or by some other permanent data medium, or by means of return of the items delivered to the contact address given below. You may return the unopened bottles to us within 14 days of receipt of the goods. We will only assume the freight charges if the return of the goods is accomplished by the freight company of our choice. We will refund the purchase price to you in full following examination of the returned goods by our staff. The guarantee is applicable according to the current legal provisions.

10. Payment
We would like to ensure that payment is as safe and simple for you as possible and we therefore offer the following options:

  • Credit card
    If you choose to make payment by credit card, we will deduct the amount to be invoiced from your credit card. We accept Mastercard and Visa. For security reasons, when you enter the credit card data we will ask for your card security code (CSC), printed on the back of the card. No credit card data is stored after your purchase: you must therefore re-enter the details for each order. Delivery will be made as soon as a successful check of the credit card data and the customer's creditworthiness has been made.
     
  • Paypal
    The amount will be paid directly to us through paypal. In case of any cancellation or resolution of the contract, your money will be refunded directly to your paypal account.
    St. Paul Winery has no responsibility for any delay or any other failure caused by Paypal.
     
  • Advance payment by means of bank transfer
    On receipt of your order we will e-mail you a proforma invoice for your order. In this case you should transfer the invoice amount to the account indicated on the proforma invoice.  Delivery will be made as soon as the purchase price is received.

11. Protection of children and young people
St. Pauls Cooperative Winery only enters into contractual relations with adult customers. For this reason customers must affirm that they are over 18 years old on sending their order. The customer must also affirm that the data concerning their age, name and address are correct. The customer in addition undertakes to ensure that deliveries are only received by him/herself in person or by an authorised adult. In the event of a breach of this condition we reserve the right to instigate legal proceedings under Italian criminal law. In the case of new clients we reserve the right to check the age of the recipient on delivery of the package by the parcel service.

12. Competent court and applicable law
This contractual relationship is subject to Italian law, which will determine the competent court.

13. Disputes with Consumers
The purchaser is hereby informed that in accordance with Article 14 of EU regulation no. 524/2013, he or she may, in the event of a dispute, submit a complaint via the online dispute resolution platform (ODR platform) of the European Union, which can be accessed via the following link: http://ec.europa.eu/consumers/odr/ (the platform will be active from 15th February 2016). The ODR platform is a point of contact for purchasers who wish to resolve out of court disputes that fall within the scope of online purchase agreements or online service contracts.
